Distance Sales Agreement

1. Parties

This Distance Sales Agreement (“Agreement”) is concluded electronically between the Service Provider identified below and the Buyer purchasing a service or service package through www.realwebtasarim.com.

Buyer

The Buyer is the natural or legal person purchasing a service by providing their name, telephone number, e-mail address and other required information during the payment process.

2. Subject of the Agreement

The purpose of this Agreement is to determine the rights and obligations of the parties concerning the sale and performance of web design, software development, digital services and other service packages ordered electronically through www.realwebtasarim.com.

The Buyer acknowledges that they have reviewed the main characteristics, scope, price, applicable taxes and any additional charges relating to the purchased service before completing the payment.

3. Service and Order Information

Information relating to the purchased service or package, including:

• service name,

• service scope,

• sales price,

• applicable taxes,

• total amount payable

is displayed to the Buyer during checkout and recorded as part of the relevant transaction.

Electronic order and payment records may be retained by Real Web Tasarım for the period required under applicable legislation.

4. Price and Payment

The applicable service price is the amount displayed on www.realwebtasarim.com at the time of purchase.

Payments may be made by debit or credit card through the PAYTR payment infrastructure.

Sensitive payment information such as card numbers and security codes is not stored within Real Web Tasarım systems. Such information is processed through the secure infrastructure of the relevant payment service provider.

An order is considered paid once the payment transaction has been successfully completed and confirmation has been received from the payment service provider.

5. Performance of Services

The scope and performance process of the service depend on the package or service purchased.

For web design, software development, custom software, graphic design, digital marketing, SEO, integration, consultancy and similar services, work may begin once the Buyer provides all necessary information, documents, content and access credentials.

Real Web Tasarım shall not be responsible for delays caused by the Buyer's failure to provide the required content, information, access credentials or approvals on time.

6. Buyer's Obligations

The Buyer acknowledges and represents that:

• all information provided during payment is accurate and up to date,

• the scope and price of the purchased service have been reviewed,

• completing the order creates an obligation to pay,

• all information, documentation, content and access required for performance of the service will be supplied on time,

• the Buyer has the necessary rights to use any content or materials supplied to Real Web Tasarım.

7. Right of Withdrawal

Where the Buyer qualifies as a consumer, the Buyer may exercise the statutory right of withdrawal within 14 days from conclusion of the service agreement, subject to exceptions provided under applicable consumer legislation.

The withdrawal notice must clearly indicate the Buyer's intention to withdraw from the agreement.

Where performance of the service begins before expiration of the 14-day withdrawal period at the express request and with the consent of the Buyer, statutory exceptions to the right of withdrawal may apply.

Additional express consent may therefore be obtained where the Buyer requests commencement of the service before expiry of the withdrawal period.

8. Cancellation and Refunds

Cancellation, withdrawal and refund requests are governed by the Cancellation and Refund Policy published on www.realwebtasarim.com.

Where the Buyer validly exercises a right of withdrawal and is legally entitled to a refund, the payment will be refunded within the applicable statutory period and, where possible, through the original payment method.

9. Obligations of Real Web Tasarım

Real Web Tasarım shall:

• provide the purchased service within the agreed scope,

• securely manage payment and transaction records,

• evaluate customer requests in accordance with applicable legislation,

• take appropriate technical and administrative measures to protect customer information.

10. Force Majeure

Natural disasters, war, epidemics, strikes, communication and infrastructure failures, server or data centre incidents, energy interruptions, decisions of public authorities, cyberattacks and similar circumstances beyond the reasonable control of the parties may constitute force majeure.

A party affected by force majeure shall not be held liable to the extent its obligations are prevented by such circumstances.

11. Personal Data

Personal data may be processed for purposes including order creation, payment processing, service delivery, customer communications, accounting and compliance with legal obligations, in accordance with applicable personal data protection legislation.

12. Intellectual Property

The use and intellectual property rights relating to designs, software, source code, documentation, visual materials and other work created by Real Web Tasarım are determined according to the purchased service and any additional terms separately agreed between the parties.

Third-party software, themes, plugins, fonts, images, APIs and other licensed components remain subject to the licensing conditions of their respective rights holders.

13. Dispute Resolution

For consumer transactions subject to Turkish law, Consumer Arbitration Committees and Consumer Courts shall have jurisdiction within the applicable statutory monetary limits.

General legal provisions shall apply to commercial transactions and other disputes that do not qualify as consumer transactions.

14. Effective Date

By completing the payment process, the Buyer acknowledges that this Distance Sales Agreement has been made available electronically and accepted before the order is completed.

This Agreement enters into force on the date it is electronically approved by the Buyer.
